In a new memorandum, President Barack Obama has offered a guideline that would have the effect of quasi-amnesty for hundreds of thousands of illegal immigrants. The memo instructs the US Immigration and Customs Enforcement to exercise “prosecutorial discretion” when enforcing immigration laws on illegal immigrants that provide evidence of enrollment in an educational facility or if relatives have volunteered for the US military.

This is clearly an overstepping on the power of the President over immigration laws. Though it did not provide new direction, it does provide for a lowering of the guard so to speak as to the current immigration thrusts of the government. This time is crucial as millions of Americans are unemployed and in exercising prosecutorial discretion, it is a step back in enforcing the law.

This is clearly a political move aimed to gather more votes for re-election in 2012. As seen, the Hispanic vote is a major stepping-stone for the re-election in garnering the swing vote in Hispanic rich areas such as Virginia and North Carolina.

There are other changes geared towards providing benefits for the Hispanic vote. These include protection of crime victims as well as witnesses, the prosecutorial discretion memo among others.
